Service-Provider Exemption Under 28 CFR § 75.1(c)(4)
LiveSlips ("the Site") operates exclusively as an electronic communication service provider, hosting provider, and content indexer for material uploaded, transmitted, or referenced by third-party users and sources. LiveSlips does not:
- Create, produce, or commission any visual depiction of actual sexually explicit conduct;
- Hire, contract, or arrange for the participation of any performer;
- Manage, supervise, or compensate any production of original content;
- Direct, script, or control the manner in which any visual depiction is created.
Because LiveSlips's activities are confined to those of a transmission/hosting/indexing service provider, LiveSlips qualifies for the exemption provided at 28 CFR § 75.1(c)(4) from the primary-producer record-keeping requirements of 18 U.S.C. § 2257 and § 2257A. LiveSlips is not a "producer" within the meaning of those statutes.
Plain English: LiveSlips hosts content provided by third parties. The legal obligation to maintain age-verification records for performers in any given visual depiction rests with the original producer of that depiction, not with LiveSlips.
User and Third-Party Producer Representations
Every user who uploads or submits visual content to LiveSlips, and every third-party source whose content is indexed or referenced by LiveSlips, is required by these Terms of Service to represent and warrant that:
- All performers depicted in the content were at least eighteen (18) years of age at the time the content was created;
- All performers consented to the recording and to the distribution of the content;
- The uploader/source is the producer of the content or has the producer's authorization to share it; and
- The producer (whether the uploader or another party) maintains the records required by 18 U.S.C. § 2257 and 28 CFR Part 75 for content depicting actual sexually explicit conduct.
LiveSlips reserves the right to require documentary proof of the above representations at any time, and to remove content for which such proof is not provided on request.
Removal of Non-Compliant Material
LiveSlips removes content expeditiously upon receipt of a credible report that the content fails to comply with applicable age-verification or consent requirements. To report suspected non-compliant content, use our Content Removal form, or contact the records-custodian email below.
